US Representative Keith Ellison (D-MN) filed two important bills this week aimed at protecting franchisees. The Fair Franchise Act of 2015 (H.3196) would prevent misleading or false information in the franchise agreement, prohibit mandatory arbitration provisions and would provide franchisees with the right to discuss their experiences with the franchisor and to join an independent franchisee association. In addition, Ellison also filed the Small Business Franchise Loan Transparency Act (H.3195), mandating that any franchise business obtaining an SBA-guaranteed loan receive average unit revenues and failure rates from the franchisor for the previous five years in their FDD. Michigan Congressman John Conyers co-sponsored both bills with Ellison, while Representative Jared Huffman (D-CA) also sponsored the Fair Franchise Act. In a press release, the Coalition of Franchisee Associations (CFA), of which DDIFO is a founding member, commended the filing of such important legislation for franchise owners.
