No, I’m not singing the George Straight country song, rather I’m reporting that the federal court in Texas has permanently enjoined the Obama administration from implementing its new persuader rule.  Recall that the so-called “persuader rule”, finalized by the Department of Labor back in March of this year, required law firms and any other consultants working on behalf of employers on unionization issues to disclose their involvement and the specific advice they were providing to employers.  US District Court Judge Sam Cummings, who had previously granted the National Federation of Independent Business (NFIB) a preliminary injunction against the rule earlier this year, revisited the issue this week.  With his latest ruling, that injunction was made permanent.  The government has appealed to the 5th Circuit Court of Appeals, however with the Trump Administration set to take office on January 20, the likelihood of that appeal moving forward under President Trump is slim at best!
