The Joint Committee on Labor and Workforce Development has reported out favorably legislation endorsed by DDIFO and pushed over the past several years. The legislation was voted out by Committee and sent for further deliberation in both the House and Senate. The tip pooling issue surfaced a few years ago with class action lawsuits exploiting a loophole in existing law that does not adequately define managers for purposes of determining tip-pool participation eligibility. The bill has previously been approved by the House but failed in the Senate in consecutive sessions by a single vote! On the flip side of the committee coin however, the committee also voted to advance a bill establishing a $15/hour minimum wage in Massachusetts. That vote comes less than one year after the legislature enacted a law phasing in increases in the minimum wage up to $11/hour by 2017.
