In yet another glaring example of a solution desperately in search of a problem, a bill pending in the Ohio state legislature seeks to ban tip pooling in Ohio restaurants. The Tip Fairness Act (HB 534), which was introduced earlier this session by Representative Nickie Antonio, would ban tip pools completely across the state. As proposed, the bill would prohibit any percentage of a server’s gross sales to be used to pay other employees of the restaurant. Although the bill may not have an immediate and glaring impact on Dunkin’ franchisees within Ohio, we are always on alert to issues dealing with restrictions on who may and who may not participate in a restaurant’s tip pool. We will keep a close watch on it.
