The proposed DOL regulation on joint employer was officially published in the Federal Register on Tuesday of this week, triggering the start of the 60-day public comment period. The proposed joint employer regulation uses a four-part test to determine when a business should be held jointly libel for minimum wage and overtime law violations. Specifically, it proposes that joint employer status would require the exercise of power to hire/fire employee, supervise/control employee work schedules or conditions, determine the rate and method of employee pay, and maintain the worker’s employment record. Subscribers wishing to submit comments may do so at www.regulations.gov in the rulemaking docket, Regulatory Information Number (RIN) 1235-AA26. Any such comments must be submitted by June 10, 2019.
