The Association of Independent Baskin Robbins Franchisee Owners (AIBRFO) filed suit in US District Court in Massachusetts Thursday against Baskin Robbins, LLC asking for relief and costs from a “commercial factor fee” that its franchisees have been paying for many years, levied through Dean Foods. This “commercial factor fee” is a special fee not relating to wholesale ice cream and other foodstuff costs that Baskin Robbins (BR) franchisees purchase with Dean Foods involvement. AIBRFO contends that it is an improper charge. This action covers only standalone Baskin Robbins franchisee owners; Dunkin/Baskin Combo store owners are not listed as parties in the complaint. AIBFRO has single store standalone BR unit members only. We will monitor this action closely as it moves through the court.
