As you’re no doubt aware, the above legal challenge to the OSHA Vaccine ETS in the 5th Circuit Court was just one of many lawsuits filed against the mandate. In fact, as many as 26 states along with many private business interests filed litigation challenging the dictate by the Biden administration. As a matter of course, when there are a multitude of lawsuits filed on an issue such as this, the courts will select – by random lottery – one court district to handle the litigation and all pending challenges will then be consolidated and heard by that one court. On Wednesday, the Judicial Panel on Multidistrict Litigation conducted the random judicial lottery and the Circuit Court of Appeals for the 6th District, headquartered in Cincinnati, Ohio was drawn as the “winner.” Moving forward, all of the pending challenges will now be consolidated and heard before the 6th Circuit Court of Appeals. There’s a strong likelihood that the issue will ultimately be decided by the Supreme Court, but there’s still a way to go before that happens.
