As the Biden administration continues trying to reverse seemingly every action of the predecessor Trump administration – especially those that are perceived as favorable to business – the Office of Federal Contract Compliance Programs (OFCCP) announced last week and published in the Federal Register that it plans to rescind a November 2019 notice regarding EEO-1 Component 2 data. That notice, which consists of aggregated employee wage and hour data, categorized by EEO-1 classification, race, ethnicity, and sex was required in 2019. Subsequently however, the OFCCP announced it would not “request, accept or use Component 2 data, as it did not expect to find significant utility in the data . . . “. Now, however the OFCCP under President Biden has determined that that 2019 decision was “premature and counter to the agency’s interests in ensuring pay equity”, consequently they are rescinding that decision and resurrecting use of the Component 2 data.
