Fair franchising issues are still in the mix in the California legislature and members are encouraged to have their California counterparts contact members of the California legislature’s Business, Professions and Consumer Protection Committee and encourage their support of SB. 610. Members may recall that SB. 610 was withdrawn earlier this year before a vote by the committee to move the bill to the Senate floor. SB. 610 would mandate a standard of “good faith and fair dealing” on the part of both parties when entering into a franchise agreement. Currently, there is no requirement for good faith and fair dealing on the part of franchisors. The bill was passed by the Senate on May 28 and sent to the Assembly where it is pending. Please contact anyone you know in California and ask them to contact Assembly members of the Business, Professions and Consumer Protection Committee and urge their support of SB. 610.
