As we advised you a couple of weeks ago, a 100% subsidy of COBRA premiums was mandated by the American Rescue Plan Act (ARPA) through September 30. The ARPA further dictated that plan administrators give advance notice to “assistance-eligible individuals” (AEIs) that their COBRA subsidy period is coming to an end. The final date by which AEIs must receive notice that the COBRA subsidy is ending is next Wednesday, September 15, 2021. The required notice must be written in clear and understandable language advising that the ARPA COBRA subsidy will expire. It must also prominently identify the expiration date and that the AEI may be eligible for coverage without any subsidy through COBRA continuation coverage or under a group health plan. The U.S. Department of Labor (DOL) has prepared a model expiration notice which you can access here. Although we’ve previously advised you of this timeline, we want to be sure that none of our subscribers are caught unaware of this deadline.
