In mid-December, the U.S. District Court for the Eastern District of New York granted final approval of a $5.54 billion settlement in the lawsuit brought by merchants against VISA, MasterCard and the largest card-issuing banks. The class action lawsuit was initiated on behalf of merchants that accepted VISA or MasterCard since January 1, 2004 and although the case is still subject to some appeals, the financial settlement has been approved and the monies deposited in escrow. Further, the final settlement creates a settlement class consisting of all persons, businesses and other entities that have accepted any VISA-branded Card and/or MasterCard-branded Cards in the US at any time from January 1, 2004 to January 25, 2019. The settlement class does not include any dismissed plaintiffs, such as those who’ve already settled and dismissed their own claims against the Defendants. The official settlement agreement can be found here, but it is not clear when the claims process will start or how long it will take.
