Although Cook County Circuit Judge Daniel Kubasiak had issued restraining orders previously against the new soda tax the county was imposing, it turned out to be a false hope as last Friday, Judge Kubasiak dissolved the injunction he had placed on the new penny-per-ounce levy that was to take effect July 1. When the injunction was lifted one week ago, the county immediately announced that the tax would be implemented in full beginning Wednesday, August 2 and Cook County did not disappoint in that regard, grabbing an additional $1.44 per twelve pack right away out of the pocket of customers. The tax was challenged by the Illinois Retail Merchants Association. It is not known whether the organization will further appeal or pursue other legal remedies, but the tax is now effective and being collected through Cook County.
