By a unanimous vote during the week before Christmas, the city council for the District of Columbia has sent an omnibus reform package that contains dictates relating all DC LLCs to Mayor Muriel Bowser for her signature. The measure, technically known as the Department of Consumer and Regulatory Affairs Omnibus Amendment Act of 2018, will have a significant impact on businesses in that it requires identification of limited partners with at least a 10% interest in all LLCs in the District. As originally proposed by Councilor Elissa Silverman, the Real Estate Transparency Act of 2018 would have only affected LLCs involved in residential real estate however, Council Chairman Philip Mendelson wanted it to reach beyond real estate to all LLCs and therefore incorporated a broader version in the omnibus package. If signed by the Mayor, it will affect LLCs created after it becomes effective in January, 2020.
