Back in January of 2019, the Center for Investigative Reporting (CIR) filed a Freedom of Information Act (FOIA) request seeking EEO-1 report data from federal contractors who filed during the period of 2016 through 2020. Since that filing, CIR has submitted several amended FOIA, most recently in June of this year. In response, the Department of Labor (DOL) through its Office of Federal Contract Compliance Programs (OFCCP) published a notice of the FOIA request in the Federal Register on August 19 advising of its intent to comply with the FOIA request. OFCCP also asks that covered contractors that object to the release of EEO-1 reports formally submit their objections within thirty days – by September 19, 2022. To facilitate this process, OFCCP has created a web page through which Covered Contractors may submit written objections on the Submitters Response Form. We are fully aware that the pending FOIA only prompts release of contractor EEO-1 information, however we wanted you to be aware of the issue should you be covered now, or should another broader FOIA request be submitted that may cover more employers in the future.
