The DOL new overtime rule has been enjoined by a federal court in Texas pending final disposition of 2 distinct legal challenges – one brought by 21 states and the other filed by a number of business (the two cases have since been consolidated in State of Nevada v U.S. Department of Labor). Notwithstanding that fact, DOL is proceeding in anticipation of the rule becoming effective on December 1, 2016. Toward that end, 10 days ago, the DOL Wage & Hour Division partnered with the Small Business Office of Advocacy to present a webinar entitled “Preparing for the Overtime Final Rule” that included a DOL briefing and a Q&A session on the overtime changes to the Fair Labor Standards Act (FLSA). In addition, DOL has also created other resources they believe may be helpful to understanding the new rule, such as a Small Business Compliance Guide. Finally, the Department of Labor has launched a hotline for compliance questions about the new rule at 1-866-4-USWAGE (1-866-487-9243).
