Although we do not have specifics at this point in time, our information from the Coalition of Franchisee Associations (CFA) and others active in the Nation’s Capital is that work is well underway within the Department of Labor to increase the overtime threshold, the so-called white-collar exemption. You will recall that under President Obama, the threshold was more than doubled from $23,660 to $50,440 until a federal court in Texas blocked the inflated threshold in 2016. Subsequently, the Trump administration increased the white-collar exemption to the more reasonable $35,308 effective on January 1, 2020. It now appears that we will have a new overtime threshold proposed by DOL sometime in early April. What that new number will be remains to be seen, but it will likely be closer to the Obama threshold than it will be to the current $35,000 plus!
