Some weeks ago, Equal Employment Opportunity Commission (EEOC) issued a new guidance essentially authorizing in general that employers may require their workers get a COVID-19 vaccine. “What You Should Know About COVID-19 and the ADA, the Rehabilitation Act, and Other EEO Laws,” answers questions about the legal parameters of such a mandate in the context of other federal laws including the Americans with Disabilities Act (ADA), Title VII of the 1064 Civil Rights Act and the Genetic Information Nondiscrimination Act (GINA). The updated publication now includes a separate section with information for both employers and employees about how a COVID-19 employer vaccination mandate interacts with other legal requirements at the federal level such as medical pre-screening questions and employer accommodations for employees unable to receive a vaccination.
