There has much written and said about the Employee Free Choice Act (Card Check) both sides do agree on one thing, if this legislation passes it will be a game changer for your business.

Currently the preferred method for determining whether or not employees want a union to represent them is through a private-ballot election overseen by the National Labor Relations Board (NLRB).

The NLRB provides detailed procedures to ensure a fair election, free of fraud. Because of NLRB safe guards, employees may cast votes confidentially without peer pressure or coercion from either side: employers or unions.

Card Check replaces private-ballot elections with public card check elections, letting unions organize a workplace if a simple majority of workers sign a card requesting union representation. This process takes away the right to a private vote that Americans have as citizens.

The concern is that the Card Check process invites coercion and abuse and leaves workers vulnerable to countless forms of pressure and intimidation.

Under the Employee Free Choice Act, once 50.1% of employees sign union cards there is a mandate to bargain. The government can enter negotiations and dictate contract terms if no agreement is reached within a certain time, thus eliminating the collective bargaining process.
