It was passed into law some 5 years ago, but with the ball falling in Times Square this New Year’s Ever, the Obama Care employer mandate officially took effect. Beginning for 2015, all companies with 100 or more full-time employees must offer an affordable health plan to 70 percent or more of their employees or they will face fines of up to $2,000 per employee. At the same time, under the existing provisions of the individual mandate, those individuals, who were not exempt and did not purchase insurance for themselves in 2014, face a penalty when they file their 2014 tax returns of 1 percent of their annual household income or $95, whichever is greater. And, with the Internal Revenue Service responsible for enforcement of a great many of its provisions, the tax consequences of noncompliance can be significant. The mandates of the Affordable Care Act are some of the most stringent and far-reaching government regulations to threaten such a broad swath of small business in history.
