Right alongside EEOC, we have the Occupational Safety and Health Administration (OSHA). Ostensibly charged with ensuring the safety of the nation’s workforce, OSHA responded to a request by the National Center for Transgender Equality by issuing a guidance advising employers that they must accommodate employees based on the gender with which the employee identifies. Incredibly, the guidance states that restricting employees to using only restrooms that are not consistent with their gender identity, or segregating them from other workers by requiring them to use gender-neutral or other specific restrooms, singles those employees out and may make them fear for their physical safety.” It goes on to speculate that in the face of such bathroom restrictions, employees may avoid using restrooms entirely while at work, which could lead to serious physical injury or illness! Really? The entire shift??
