A California jury finally decided damages this week in a landmark lawsuit the same jury decided in favor of the plaintiff franchisees last December – and good things are really worth the wait. The 12 men and women on the jury awarded the plaintiff franchisees $8.8 Million in damages! The husband and wife franchisee team (the Brymans), represented by premier franchisee attorney Robert Zarco, challenged franchisor El Pollo Loco Inc. after the company opened two corporate restaurants within a few miles of two stores the Brymans owned as El Pollo franchisees. In short, the jury found that the franchisor breached its implied covenant of good faith and fair dealing when it opened competing restaurants. There’s much more to this landmark decision and award and Attorney Zarco will be speaking to all of them at the DDIFO National Conference in New Orleans next month. Zarco will be the featured presenter on Encroachment, the Impact of Private Equity and Other Legal Trends on Monday, June 11 at Harrah’s New Orleans Hotel and Casino. Plan to attend and learn the impact of this decision on franchisor encroachment!
