The US Immigration and Customs Enforcement (ICE) ten days ago issued another temporary extension of the flexibility in the compliance rules regarding the Form 1-9 for another few weeks. Under this latest 30-day extension, the requirement for in-person, physical inspection of the identity and employment eligibility documentation of new hires is deferred again and is now scheduled to expire on September 19, 2020. Of course, the “fly in the ointment” so to speak, is the fact that this flexibility doesn’t apply to all businesses, and to underscore that fact, ICE specifically reminded employers that the policy only applies to employers and workplaces operating remotely. Further, the agency underscored that “no exceptions are being implemented at this time for in-person verification and employment verification documentation for Form 1-9.” The flexibility in the compliance rules was originally implemented back in March and has been extended twice since that time. Pending another extension, the deferral will now expire in three weeks.
