When the coronavirus pandemic hit the nation over two years ago, the rules governing employer obligations for in-person inspection of employee documentation were relaxed, allowing for remote review of I-9 documentation. A few weeks ago, U.S. Immigration and Customs Enforcement (ICE) announced it was extending that flexibility through October 31, 2022, however, only in the case of employees working remotely. For other employees who specifically work at a company’s location, the old rules still apply and the employer is required to review the employee documentation associated with employment eligibility in-person as part of the hiring process. Regardless of whether you have remote employees or not, it may be wise for you to regularly review your I-9 files and verification process to ensure continued compliance.
