With more states legalizing the use of marijuana, both medical and recreational, it is becoming more and more of an issue that small business owners need to brush up on. Colorado and Washington started the joint, errh, ball rolling, back in 2012 when voters authorized recreational use of the drug. Since that time, 6 other states (Alaska, California, Maine, Massachusetts, Nevada & Oregon) have legalized recreational use, while 25 have legislated parameters for the legal use of marijuana for medicinal purposes. What does legalization mean for a drug-free workplace and/or a zero-tolerance employment policy and what are the pitfalls for employers in those states?
