Writing these stories each week about government overreach and the many more restrictions being placed on businesses across the country, it is refreshing when we can report on something going the other way. Texas Attorney General Ken Paxton filing suit against Brownsville, Texas is just such a story. The republican AG filed in state District Court this week in Brownsvillle challenging the border town over an environmental fee it began imposing this past January. Although the plastic bag fee was approved at the local level, the suit alleges that the $1 “environmental fee” on plastic bags at store checkouts is in reality an illegally imposed sales tax. Since the imposition of the fee, Brownsville consumers have paid $3.6 million in plastic bag fees. We do not have a timetable for the court to rule on the matter, but we will keep an eye out for the decision.
