Beginning today, May 1, 2020 employers must use the newer Employment Eligibility Verification Form (with the revised date of 10/21/19-found in the bottom left-hand corner). Form I-9 is published by the US Citizenship and Immigration Service (USCIS) and changed periodically to address current issues. For the past three months, notwithstanding the coronavirus crisis, employers have been allowed to use either the new version (revised 10/21/19) or the older version (revised on 7/17/17), however only the latest version will be acceptable from this point on. Although against the backdrop of the COVID-19 pandemic and the current national and local social distancing guidelines, employers may benefit from temporary changes in I-9 procedures adopted by the Department of Homeland Security (DHS) back in March. At that time, DHS confirmed that employers may defer the I-9 physical presence requirements until May 19, 2020 or within three business days after termination of the National Emergency, whichever comes first.
