New York put the HEROES Act on the books back in May of this year, but the new law has a number of different triggers that employers in the Empire State should be aware of. The first of those comes next Thursday, August 5, 2021, when employers are required to adopt a worker health and safety plan. Employers may adopt a model plan developed by the state, or create their own that exceeds the state minimum standards. Either way, the plan need not yet be implemented, but adoption of a plan is required by Thursday. Employers will then have until September 4, 2021 – or 30 days after their plan in adopted – to provide or communicate the safety plan to their employees, while other provisions will kick in on other dates.
