Earlier this week, General Counsel of the National Labor Relations Board (NLRB) and the Chairman of the Federal Trade Commission (FTC) executed a Memorandum of Understanding (MOU) between the two federal agencies pledging cooperation to promote fair competition and advance workers’ rights. Signed by NLRB GC Jennifer Abruzzo and FTC Chair Lina Kahn, the MOU calls for the two agencies to share information in specific areas of mutual interest, including labor market developments relating the “gig economy”. In addition, the MOUs speaks to miscalculation of workers and algorithmic decision-making along with the extent and impact of labor market concentration and the ability of workers to act collectively. The agreement also comes after the NLRB joined the FTC’s Consumer Sentinel Network (CSN), an investigative online tool and complaint database for enforcement agencies from US, state, local and foreign governments.
