For a period of three months that began on July 1, restaurants, bars and other food establishments in the state of Colorado will benefit from a novel assistance program – a complete reprieve of state sales taxes through the end of September. The program, passed by the legislature as HB22-1406 and signed into law by Governor Jared Polis last month, is expected to save eligible retailers as much as $40 million over the course of the three-month program. Eligible businesses, which include restaurants, bars, and food service contractors as well as caterers and mobile food service retailers (food trucks) will be allowed to deduct – up to a maximum of $70,000 – their total taxable sales during the period from the amount of sales taxes that would otherwise be remitted to the state. The reprieve effectively reinstates an earlier sales tax moratorium that expired last September.
