Earlier this month, we advised you that the Department of Labor through its Office of Federal Contract Compliance Programs (OFCCP) was intending to comply with a Freedom of Information Act (FOIA) request and release EEO-1 reports filed by private employers. Further, at that time, OFCCP had set a deadline for the filing of objections of Monday of this week, September 19, 2022. Since that time however, OFCCP has amended its scheduled release of the information and established a new deadline of October 19, 2022 for the filing of written objections. Such objections may still be filed with the OFCCP through its Submitter Notice Response Portal. Again, we are aware that the FOIA currently only applies to contractor EEO-1 information, but want you to be fully aware of the ongoing issue.
