As we advised a few weeks ago, the Department of Labor has published its proposed new regulation on the overtime threshold, increasing the amount below which all employees must be eligible for overtime pay. DOL has proposed that the threshold salary be set at $35,308 and publication of the rule in the Federal Register (March 21, 2019) triggers the opening of the 60 day public comment period. Those wishing to comment one way or the other on the proposal may do so electronically through May 21 by submitting comments directly at, in the rulemaking docket RIN 1235-AA20. More information about the proposed rule is available on the DOL Wage & Hour Division website.
