Another interesting initiative in Congress seeks to deal with the proliferation over the past several years of so-called worker centers. These “worker centers” are thinly veiled union operations that operate outside federal labor law and skirt regulations that have been adopted to ensure that labor organizations operate within the law.  H.R. 5665, filed by Florida congressman Francis Rooney would expand the current definition of a labor organization under the Fair Labor Standards Act (FLSA) to include groups taking any action to pressure employers into accepting or changes terms of employment. The legislation, which would apply to such groups as Restaurant Opportunity Centers (ROCs) and Young Workers United, among others, has been endorsed by a number of business advocacy groups – most recently, the Retail Industry Leaders Association which last week sent a letter of endorsement to Representative Rooney.
