In the wake of a federal court ruling that found the Restaurant Revitalization Fund (RRF) priorities (women, veterans and economically/socially disadvantaged individuals) unconstitutional, the Small Business Administration (SBA) has withheld almost 3,000 additional RRF approved payments to priority recipients. The SBA essentially revoked the priority approvals already given and halted consideration of other priority applications (estimated at tens of thousands) until such time as all previously filed non-priority applications are processed – first-come, first-served. Several federal courts across the country reached similar conclusions that a race- and sex-based exclusivity window mandated by Congress for the SBA to use violates the Equal Protection Clause of the US Constitution.
