Just one day after the aforementioned joint-employer hearing, the US Senate Committee on Health Education Labor and Pensions took their turn. Yesterday, the Committee formally considered the nomination of two individuals put forward by President Trump to fill the final two empty seats on the National Labor Relations Board. Nominees Marvin Kaplan, a counselor at the Occupational Safety and Health Review Commission, and William Emanuel, a management-side attorney with Littler Mendelson are both expected to win Committee approval at the committee Executive Session next Wednesday. In light of the republican majority in the Senate, the two are virtual locks to ultimately win confirmation. Also at yesterday’s hearing, the same committee heard testimony on the nomination of Patrick Pizzella as deputy Labor Secretary. Pizzella, nominated by President Trump, is currently the acting Chairman of the Federal Labor Relations Authority and also served as assistant Labor Secretary in the George W. Bush administration.
