With the US House of Representatives passing the so-called Speak Out Act two weeks ago, the measure was presented to the White House yesterday for President Biden’s signature. He is expected to sign the measure. The bipartisan bill, S.4524, passed by the Senate in September, makes pre-dispute non-disclosure agreements unenforceable. Once signed by the President, the law will take effect immediately and prevent employers from forcing victims of sexual harassment and/or assault to remain quiet regarding the abuse and further may require some employers to alter their business practices in order to comply. Under the bill, an employee who signed an NDA upon hire that prohibits them from telling colleagues or others about sexual misconduct in the workplace will subsequently be enabled to speak out about the harassment without any legal repercussions. Employers however, may still utilize standard confidentiality agreements with claimants upon settlements.
