Notwithstanding the challenges that such a new joint employer definition will bring to the broader business community, the Senate appears to be moving closer to a confirmation vote for Julie Su. Currently the secretary of labor for the state of California, Su was nominated by President Biden to the position of Deputy Secretary of Labor back in early February. Her confirmation however encountered difficulties as she was heavily criticized for her role in overseeing the payment of $11 billion in fraudulent unemployment claims in California. The Senate HELP Committee advanced her nomination to the Senate floor on a straight party-line vote back in April, but there was no movement on the matter until Senate Majority Leader Chuck Schumer filed closure on the nomination last week which clears the way for a vote. The Senate is currently on a two-week July 4 recess however, so no final vote will be taken until later this month
