Despite the major defeat it recently suffered over the joint employer battle detailed above, the Service Employees International Union (SEIU) and its allies on the presidential campaign trail will not just tuck their tales and go away. To the contrary, having enjoyed much success across the nation with their Fight for $15 campaigns, SEIU is now targeting Chipotle and McDonalds for concerted union organizing efforts.  In fact, one of its local unions, Manhattan based Local 32BJ, which boasts some 175,000 union members has already undertaken a unionizing campaign where Chipotle and McDonald’s workers are being asked to sign union request cards with which the local will ultimately petition the National Labor Relations Board (NLRB) for a union representation election. Notwithstanding that in the absence of a joint employer determination, these workers may not work for the same franchisee, the coordination of employee representation efforts could easily lead to local unionizing within specific restaurant groups – and that union organizing will be more narrowly focused, and that much more challenging to defeat!
