It certainly didn’t take long for the true impact of the NLRB new “ambush election” rule to be felt across the country. In a supplemental brief filed by the Associated Builders and Contractors of Texas in their legal challenge to the “ambush” rule, they report that just since the rule became effective on April 14 of this year, an additional 141 election petitions have been filed. Under the new rule, the filing of the petition starts an accelerated clock on the employer and dramatically restricts what the employer can say about the union’s efforts and greatly increases their responsibilities to provide the union with a significant amount of additional employee information. The ABC lawsuit is pending in the US District Court for West Texas.
