With the passage of Senate Bill 245, West Virginia made the use of payroll card payments that much easier for employers in the Mountain State. Up to this point, payroll cards were an acceptable form of compensation in West Virginia, but only if both the employer and the employee agreed. Now, in the wake of SB245, the employer can unilaterally decide to compensate his/her workforce with payroll card payments, provided that the employer discloses any fees associated with the card in writing. In addition, the employee must be able to make at least one withdrawal or transaction per pay period without being subjected to any cost or fee. The new provisions will become effective June 9, 2022, 90 days after it was signed into law by Governor Jim Justice.
